Recently, a customer contacted me because he couldn't find the option to apply for a visa as a civil union partner (PACS). Here's his background:
After entering into a civil union (PACS) with his French partner and spending several years abroad, they decided to settle in France. But he was surprised to learn that a PACS does not grant visa rights in France.
Why ?
Because PACS and marriage do not have the same effects in France. Unlike marriage, which opens up rights to family reunification or a visa, PACS does not offer these facilities if you are outside France.
What this means in practice:
- The PACSÉ foreign partner will not be issued a visa on the basis of the PACS
- There is no shortcut to obtaining a 10-year residence permit on this basis
- No reduced time limit for applying for French nationality
Although PACS is simpler than marriage, you need to be aware of its limitations.
So, if you're in a civil partnership, you'll need to consider other types of long-stay visa if you want to live peacefully with your partner in France.
Once you have obtained this visa and are settled in France, you can apply for a residence permit on the basis of the PACS.
However, even in France, the PACS alone is not enough to obtain a residence permit, contrary to popular belief: you'll also need to prove that you've lived together for a certain length of time, provide proof of means of support and meet other criteria required by the authorities.
